EasyStory is a tool for small and medium businesses (SMBs) to generate before & after photos for marketing purposes. Users can submit photos by sending them via text message after signing up and agreeing to receive SMS communications.

3. Consent to Receive SMS

By signing up for EasyStory, you consent to receive SMS messages from us, including prompts to upload before and after photos, service notifications, and marketing messages. Message and data rates may apply. You can opt out at any time by following the instructions in our messages.

4. Submitting Photos

After registration, you will be prompted to upload your before and after photos by replying to our SMS prompts. You are responsible for ensuring that the photos you submit are accurate, appropriate, and do not violate any laws or third-party rights.

5. User Responsibilities

• Only upload photos you have the rights to use and share.
• Do not submit content that is illegal, offensive, or infringes on the rights of others.
• Ensure that all before & after photos accurately represent your work or business.

6. Privacy and Data Use

7. Intellectual Property

The service and its original content, features, and functionality are owned by EasyStory and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your uploaded photos, but grant EasyStory a license to use them for providing the service.

8. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

9. Limitation of Liability

In no event shall EasyStory, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Subscription Service

EasyStory offers a subscription service that is billed on a recurring 30-day basis. By subscribing, you authorize us to charge your chosen payment method at the start of each subscription period. Your subscription will automatically renew every 30 days unless you cancel before the renewal date. You may cancel your subscription at any time, and your access will continue until the end of the current billing period. No refunds will be provided for partial periods. It is your responsibility to manage and cancel your subscription as needed. We reserve the right to change subscription fees with reasonable notice.

11. Modifications to Service and Pricing

EasyStory reserves the right to modify or discontinue the service (or any part thereof) and to change pricing at any time, with or without notice. We will make reasonable efforts to notify you of significant changes. Continued use of the service after such changes constitutes your acceptance of the new terms or pricing.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EasyStory operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the use of the service shall be resolved through good faith negotiations. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts in our principal place of business.

15. User Content and License

You retain all rights to the photos and content you upload to EasyStory. By submitting content, you grant EasyStory a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating, promoting, and improving the service. You represent and warrant that you have all necessary rights to grant this license.

16. Data Security

We implement reasonable security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

17. Third-Party Services

EasyStory may use third-party services such as SMS providers, payment processors, or analytics tools. We are not responsible for the actions, content, or privacy practices of these third parties. Your use of such services is subject to their terms and policies.

18. Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. Do not share your password with anyone. Notify us immediately if you become aware of any unauthorized use of your account.

19. Indemnification

You agree to indemnify, defend, and hold harmless EasyStory and its affiliates, officers, agents, employees, and partners from any claim, liability, loss, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of another.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by EasyStory, constitute the entire agreement between you and EasyStory regarding your use of the service, superseding any prior agreements.
